Withdrawal policy
Right of withdrawal for consumers under the EU Consumer Rights Directive (as applicable in the Republic of Cyprus)
1. Right of withdrawal
If you are a consumer (a natural person placing the order for a purpose that is predominantly outside your trade, business or profession), you have a right of withdrawal in accordance with statutory provisions.
The withdrawal period is 14 days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (TORCHTECHNOLOGY LTD, a private limited liability company registered in the Republic of Cyprus, registered office: 25 Martiou, 27, D. MICHAEL TOWER, Office 105A, Egkomi, 2408 Nicosia, Republic of Cyprus, email: hello@torchtechnology.de) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form below, though it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
2. Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal. We will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement.
3. Early commencement of the service and compensation for value
If you requested that we begin providing the Software before the end of the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the service already provided up to the point at which you notified us of your withdrawal, compared with the total scope of the contractually agreed service.
We expressly draw your attention to this during checkout and obtain your consent to it.
4. Expiry of the right of withdrawal
The right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium if performance has begun with the consumer’s express consent and the consumer has confirmed that they thereby lose their right of withdrawal.
The right of withdrawal also expires in the case of service contracts if we have fully performed the service and you expressly consented to the commencement of performance while acknowledging that you lose your right of withdrawal upon our complete performance of the contract.
5. Note on the free trial
The free trial is not a paid contract. It ends automatically and does not need to be withdrawn from or cancelled. The withdrawal period begins only when you subsequently enter into a paid subscription.
